By accessing or using the Scalemark website and services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

Our Services

Scalemark provides operational intelligence and automation systems, growth and acquisition systems, visibility and modern search optimization, bespoke intelligence platforms, and AI training and enablement programs. The specific scope, deliverables and timeline of each engagement are defined in a written proposal or agreement.

Engagements & Pricing

Prices shown on our website are indicative and exclusive of applicable taxes unless stated otherwise. Final pricing is confirmed in writing before any work begins.

The Strategic Audit fee is fully deducted from any engagement signed within 30 days of the audit's delivery. Subscription services, such as Premium Orchestration, are billed monthly and can be cancelled at any time, with cancellation taking effect at the end of the current billing period.

Payment Terms

Invoices are payable within the period stated on the invoice. We may pause work on an engagement if payments are overdue. Fees already paid for completed work are non-refundable, unless otherwise agreed in writing.

Client Responsibilities

To deliver our services effectively, you agree to provide accurate information, timely access to the relevant tools, systems and people, and feedback within reasonable timeframes. Delays in providing these may affect delivery timelines.

Intellectual Property

All content on this website — including text, design, graphics and logos — is the property of Scalemark and may not be reproduced without our written permission.

Upon full payment, ownership of the deliverables created specifically for you is transferred to you, as defined in your agreement. Scalemark retains ownership of its pre-existing methods, frameworks, tools and know-how.

Confidentiality

Both parties agree to keep confidential any non-public information shared during an engagement and to use it only for the purpose of that engagement. This obligation continues after the engagement ends.

Third-Party Tools

Our systems may rely on third-party platforms and AI providers. Scalemark is not responsible for changes, interruptions or pricing updates made by these providers, but we will work with you to adapt your systems where needed.

Limitation of Liability

Our services are provided with professional care and diligence. To the extent permitted by law, Scalemark is not liable for indirect or consequential losses, including loss of profits or data. Our total liability for any engagement is limited to the fees paid for that engagement.

Changes to These Terms

We may update these Terms of Service from time to time. The "Last updated" date at the top of this page shows the latest version. Continued use of our website or services after changes means you accept the updated terms.
